Terms of Service

1. Acceptance of Terms

By creating an account or using the MoonStore platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including developers who list applications and end users who purchase them.

2. Description of Service

MoonStore is a commerce infrastructure platform that enables independent software developers ("Developers") to sell applications, subscriptions, and digital products to end users ("Customers"). MoonStore facilitates payment processing via Stripe Connect, manages entitlements, and provides developer tooling. MoonStore is not the seller of record; Developers are responsible for their own products.

3. Eligibility

You must be at least 18 years of age and capable of forming a legally binding contract to use this Service. By using the Service, you represent and warrant that you meet these requirements. Developers must additionally complete identity verification (KYC) and connect a valid Stripe account to receive payouts.

4. Developer Responsibilities

Developers who list products through MoonStore agree to:

• Provide accurate product descriptions and pricing.
• Deliver the product or service as described to Customers.
• Comply with all applicable laws, including consumer protection and export laws.
• Handle Customer support for their products.
• Not list products that violate intellectual property rights, contain malicious code, or facilitate unlawful activity.

5. Fees and Payments

MoonStore charges a platform fee on each transaction, expressed as a revenue split percentage configured at the time of Developer onboarding. Payouts to Developers are processed through Stripe Connect according to your configured payout schedule. MoonStore reserves the right to update its fee structure with 30 days' notice. All fees are non-refundable unless otherwise required by law.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Engage in fraudulent transactions or chargebacks abuse.
• Reverse-engineer, decompile, or otherwise attempt to extract source code of the Service.
• Use automated means to access the Service without prior written consent.

7. Intellectual Property

All intellectual property rights in the MoonStore platform, including software, branding, and documentation, are owned by MoonStore or its licensors. Developers retain ownership of their own applications and content. By listing a product on MoonStore, Developers grant MoonStore a limited, non-exclusive license to display and promote the product within the Service.

8. Termination

MoonStore may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or for any other reason with or without notice. You may terminate your account at any time by contacting support. Upon termination, your access to the Service will cease and any pending payouts will be processed according to applicable law and Stripe's terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MOONSTORE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOONSTORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. MOONSTORE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO MOONSTORE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in a court of competent jurisdiction, as required by applicable law.

12. Changes to Terms

MoonStore may update these Terms from time to time. We will notify you of material changes by updating the version date at the top of this page and, where appropriate, via email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
